I get the following error:&lt;/p&gt;
&lt;p&gt;&amp;quot;The upgrade patch cannot be installed by the Windows Installer service because the program to be upgraded may be missing, or the upgrade patch may update a different version of the program. &amp;nbsp;Verify that the program to be upgraded exists on your computer and that you have the correct upgrade patch.&amp;quot;&lt;/p&gt;
&lt;p&gt;I have installed the Windows XP Embedded Eval version successfully, rebooted and still get this error. &lt;/p&gt;
&lt;p&gt;Any ideas? &lt;/p&gt;

&lt;p&gt;The bits in the &amp;quot;Evaluation&amp;quot; version are exactly the same as the one you'll later see in the OEM secure site.&lt;/p&gt;
&lt;p&gt;As Andy said in the blog article, what's different is the license. Again, note: &amp;quot;you'll have to uninstall and revert back to SP2 and then install Retail when it's up on the Secure site.&amp;quot;&lt;/p&gt;

To download the eval version you're accepting a license that says you won't ship software based on the eval. Yes, i agree this seems odd because the bits are binary and windiff identical! Because of this I will continue to try to drive change in this process so that it makes more sense and doesn't affect you in the future. &lt;/p&gt;
&lt;p&gt;In the meantime, please accept my apology for any inconvenience or confusion this is causing.&lt;/p&gt;

&lt;p&gt;There is no technical requirement to re-install it after the OEM version is available, but MS legal team wants you to say you downloaded it from the OEM site? This is classic.&lt;/p&gt;
&lt;p&gt;Also of note is that several places in the help files and read-me files link to the MS Connect beta site located on the current eval .ISO. I guessing this is a mistake for a final release product.&lt;/p&gt;
